Haneef legal team fights for release of documents

Lawyers for former terror suspect Mohamed Haneef hope they can successfully appeal against a refusal by the Immigration Department to release documents on last year's bungled case.An application was filed in the Commonwealth Administrative Appeals Tribunal (AAT) in Brisbane yesterday to dispute the department's decision to withhold documents from Dr Haneef's legal team.His lawyer, Rod Hodgson, said documents obtained under Freedom of Information had been heavily edited on several grounds, but could be vital to the current federal government inquiry into the case, headed by retired NSW Supreme Court judge John Clarke QC.Mr Hodgson said the application sought to fast-track the process of the AAT so a decision was made before the Clarke inquiry is due to report in September."We've asked for documents we believe are relevant held by that department," Mr Hodgson told AAP."They've said 'No'."We want an umpire to make a decision on the access to those documents."We want the umpire to put our case at the top of the queue because of the current constraints with the Clarke inquiry."He said it was hoped a decision would be made early next week on whether the case could be fast-tracked.Mr Hodgson said the AAT was the last chance Dr Haneef's team had of guaranteeing the documents could be viewed by the inquiry, due to the inquiry's lack of powers to compel the release of documents from potential witnesses."What we have are a number of pieces of the jigsaw puzzle as to what happened last year - there are many pieces missing," he said."Whilst we're hopeful at the promise of the full cooperation given by the agency will come to fruition, the absence of powers that the inquiry has at the present time means that if the agency decides that they're going to take the same approach to the inquiry as they've taken to us... the inquiry can't compel the production of those documents."Dr Haneef was held without charge for 12 days after being arrested at Brisbane International Airport last July for his alleged links to a failed terrorist plot in the UK.The Indian national was eventually charged with supporting terrorism but the charge collapsed within days, prompting his return to his family in Bangalore.
